Using images of children to create AI deepfake images of a sexual nature would be illegal if a state lawmaker has his way. Representative Michael Bayham has filed a bill that would classify deepfake content involving children as child sex abuse material if it’s sexually explicit in nature.

“The more I’ve looked into AI, the more I’ve encountered cases and news sites where it’s been abused and exploited,” Bayham noted.

The Republican from St. Bernard Parish says because it’s such a new technology, AI is currently not addressed in Louisiana statutes, and he’s looking to close that loophole to protect the most vulnerable.

“It just as society adapts to new technological advances, we need to ensure that the statutes are also adapted to protect the public interests, particularly our children,” Bayham said.

Bayham says while some may have concerns that regulating A-I could stifle free speech, this is not what his bill is all about.

“Clearly, this isn’t about the First Amendment. This is about exploitation of children, and the images of children,” Bayham said.
